Terms of Service

1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of the Encore Studio websites, applications, and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you use the Service on behalf of a studio or other organization, you represent that you have authority to bind that organization, and "you" refers to it.
2. The Service
Encore Studio provides software for managing music studios, including scheduling, enrollment, quotes and contracts with electronic signature, invoicing and payments, and portals for teachers and clients. We may improve, modify, or discontinue features of the Service, and will provide reasonable notice of any material reduction in functionality.
3. Accounts and responsibilities
You are responsible for the accuracy of the information you provide, for safeguarding access to your account, and for all activity that occurs under it. You must notify us promptly of any unauthorized use. Studio administrators are responsible for managing the roles and permissions they grant to teachers, staff, and clients within their workspace.
4. Subscriptions and billing
The Service is offered on paid subscription plans billed monthly or annually in advance. Fees are stated in U.S. dollars and are exclusive of applicable taxes. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. Except where required by law, fees are non-refundable; when you cancel, you retain access until the end of the current billing period.
5. Payments processed through the Service
Payments between studios and their clients are processed by third-party payment providers subject to those providers' terms. Encore Studio is not a party to the underlying agreements between a studio and its clients and is not responsible for the lessons, services, or refund policies studios offer.
6. Customer content
You retain all rights to the data you and your clients submit to the Service ("Customer Content"). You grant us a limited license to host, process, and display Customer Content solely to provide and improve the Service. You are responsible for ensuring you have the rights and consents necessary to submit Customer Content, including any personal information about students and families.
7. Acceptable use
You agree not to misuse the Service, including by attempting to gain unauthorized access, interfering with its operation, reselling it without authorization, uploading unlawful or infringing content, or using it to send spam or deceptive communications. We may suspend or terminate accounts that violate these Terms.
8. Electronic signatures
The Service allows documents to be executed electronically. You agree that electronic signatures collected through the Service are intended to be valid and enforceable to the fullest extent permitted by applicable law, and that you are responsible for determining whether electronic execution is appropriate for a given document.
9. Disclaimers and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, Encore Studio will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us in the twelve months preceding the claim.
10. Termination
You may cancel your subscription at any time from your billing settings. We may suspend or terminate your access for material breach of these Terms after reasonable notice where practicable. Upon termination, you may export your Customer Content for a limited period, after which we may delete it in accordance with our data retention practices.
11. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email before the changes take effect. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
